Legal construction for process of conversion traditional banks to ISLAMIC banks

Abstract

This research aims to statement a number of contemporary issues related to the banks in the financial and banking sector, such as Riba, fraud and taking benefits and disrupt transactions lawful, as well as showing the most significant developments in this sector, such as transition from traditional bank to the Islamic bank - especially under the global financial crisis - and the disclosure of the reasons for the motives of the transition Theoretically and jurisprudence based on religious texts and the general rules of Islamic law, and the research focused in depth the issue of adaptation and select  basics of the idea of adaptation for the transformation of conventional banks to Islamic.

The research is divided into two sections and conclusion, first topic for statement the concept of the basic terminology of the subject, also the causes and motives of banking transformation, and the second in the applied field and the intellectual bases of the issue of transformation and legitimacy which was establish on the basis of texts and applications jurisprudential legitimacy, and the conclusion include the search results.
